分割出願はオーストラリアとニュージーランド両国で任意で行うことができ、発明または好ましい商業的実施形態の複数の側面を保護する有益な方法となり得ます。ただし、いずれの管轄区域も、出願人が親出願と分割出願で同一の主題をクレームすること(すなわち二重特許)を禁止する法律を定めています。オーストラリアとニュージーランドとでは法自体もその解釈もまったく異なるため、通常、親出願と分割出願のクレーム戦略はそれぞれの管轄区域で異なるものとする必要があります。
