YantaiJereh opposed the registration of the trade mark JEREH Stylised that was filed by Pioneer Petroleum in relation to mining machinery in Class 5.
The opponent led evidence of its use of the trade mark JEREHin relation to Class 7 machinery since ‘well before the priority date’ of the Pionner Petroleum application. As Pioneer Petroleum did not participate in the Hearing, the Hearing Officer found in favour of the opponent under section 58.
The application was refused registration.
