Need more time? Don’t stress! Australia and New Zealand national phase deadline for pre-America Invents Act PCT applications

We appreciate our American colleagues are currently battling a wave of foreign PCT national phase entry patent filings, following the rush of US applications filed in anticipation of provisions of the America Invents Act coming into effect on 16 March 2013.

Whilst the 30 month national phase deadline is imminent for most countries, an extra month is available in Australia and New Zealand (31 months from the priority date). This provides a national phase entry deadline of early to mid-October 2015 for PCT applications with a priority date of early to mid-March 2013.

If we can assist you to take advantage of this extra time to file in Australia and New Zealand please let us know.

All we need to enable us to secure a national phase entry filing in Australia or New Zealand for any of these US filed PCT applications is the PCT application / publication number (although we would also appreciate a copy of the specification in Word format if possible).
