The High Court of Australia has this morning handed down its decision that the Tobacco Plain Packaging Act 2011 (Cth) is not contrary to s 51(xxxi) of the Constitution (concerning the acquisition of property on just terms) and has made orders to that effect.
The case came about after the Federal Government introduced the legislation to parliament in April last year. See our previous news alert here.
The court will publish reasons for the decision at a later date.
